Chris Brown avoided incarceration for a 2023 nightclub assault after receiving a suspended sentence in London on Monday. The 37-year-old pop star was sentenced to eight months in prison, a term suspended for one year. This legal resolution clears the path for his upcoming tour, which had been paused in the United States.

The incident occurred in February 2023 at Tape, a private club in London’s Mayfair district. Brown struck Abraham Diaw, a music producer and former friend, twice in the head with a tequila bottle. He pleaded guilty to affray in July. The charge carries a maximum penalty of three years in prison. Prosecutors dropped additional charges for assault, attempting to cause grievous bodily harm, and possessing an offensive weapon in exchange for the guilty plea.

Brown’s legal team argued that the attack lasted no more than 20 seconds. Defense lawyer Sallie Bennett-Jenkins described the event as an ugly incident and said Brown offered a profound apology to everyone present. The defense emphasized Brown’s stable employment and charity work as mitigating factors. Judge Tony Baumgartner agreed that Brown did not qualify for a custodial sentence. The judge noted that Brown had maintained a clean record in recent years despite previous convictions.

Prosecutor Heidi Stonecliffe stated that Brown played a leading role in the violence. She noted that video footage showed Brown moving first and using a glass bottle aimed at the head. Judge Baumgartner acknowledged the danger of the weapon but cited the guilty plea and other circumstances to justify the suspended term. Brown’s friend and vocal coach, Omololu Akinlolu, also pleaded guilty to affray and received a four-month suspended sentence.

The sentencing follows a brief cancellation of the Brown and Usher tour. Organizers canceled a scheduled October 17 performance at M&T Bank Stadium in Baltimore and other U.S. dates. They cited the health and well-being of the touring company. The tour is set to resume on November 5 in Atlanta. Brown had been free on a 5 million pound bail bond since his arrest in May 2025 at a Manchester hotel. That bail allowed him to tour Europe and North America over the past two summers.

Fans greeted Brown outside Southwark Crown Court. He wore a black mask, dark glasses, and a black ball cap over bleached hair. He blew a kiss to one supporter and signed an autograph for another. One onlooker shouted that violence is not okay as Brown arrived. The singer has won two Grammys for best R&B album, the first in 2011 and the second in 2025.

Diaw was discharged from the hospital with head and knee injuries. Brown has faced legal trouble since a 2009 felony conviction for assaulting Rihanna. He was arrested in Paris in 2019 on suspicion of rape but was released without charge. He has also faced arrests in several U.S. states, though prosecutors dropped those charges.
